These terms tell you who we are, how we will supply products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. Please read them before placing an order.
1. Who we are and how to contact us
This website is operated by Perfect Packaging Solutions Ltd, a company registered in England and Wales under company number 13440029. Our registered address is Unit 5 Flanshaw Business Park, Kelly Way, Wakefield, WF2 9FR.
You can contact us by email at support@perfectpackaging.co.uk or by telephone on (+44) 0800 048 7510. If we need to contact you we will do so by telephone or by writing to the email address or postal address you gave us when placing your order.
2. Consumers and business customers
Some of these terms apply differently depending on whether you buy as a consumer or as a business. You are a consumer if you are an individual buying products wholly or mainly for your personal use. You are a business customer if you are buying products wholly or mainly for use in connection with your trade, business, craft or profession.
Where a section applies only to one or the other, it says so. Nothing in these terms affects your statutory rights as a consumer.
3. Our contract with you
Placing an order is an offer to buy. Our acceptance of your order takes place when we send you written confirmation that we accept it, at which point a contract comes into existence between you and us. If we cannot accept your order we will tell you and will not charge you.
Order confirmation is generated automatically and confirms what you have ordered. It does not guarantee that the products are in stock. If a product turns out to be unavailable we will contact you to arrange an alternative or a refund.
4. Products, specifications and suitability
Product images and descriptions are provided for guidance. Dimensions, weights and capacities are approximate and are subject to normal manufacturing tolerances. Colours may vary between production batches and may not reproduce exactly on your screen.
You are responsible for satisfying yourself that a product is suitable for your intended use - for example that a box, bag or protective material is appropriate for the goods you intend to pack, the way they will be handled, and the carrier or postal service you intend to use. If you are unsure, contact us before ordering and we will do our best to advise. Where we give advice we do so in good faith, but the final decision on suitability is yours.
Some products are sold in fixed pack quantities. The pack quantity forms part of the product description and is shown on the product page.
5. Prices and payment
Prices are shown on the product page and may be exclusive or inclusive of VAT as indicated. VAT at the prevailing rate is shown at checkout before you commit to your order. Delivery costs are additional unless stated otherwise and are shown at checkout.
Payment in full is taken on all orders when they are placed, before any goods are dispatched, unless otherwise stated at checkout. This mirrors our Payment & Delivery Policy.
We take reasonable care to ensure prices are correct. If we discover an error in the price of the products you have ordered we will contact you to ask whether you wish to proceed at the correct price or cancel. If we cannot reach you we will treat the order as cancelled and refund you in full.
6. Delivery
Delivery will usually occur within the estimate given at checkout before you place your order. Delivery after that estimate may occur in rare cases due to courier delays or other unforeseen circumstances. If your items have not arrived within the estimate, please contact us.
Goods will normally be delivered by the courier shown at checkout, but we reserve the right to use a different carrier where we consider it necessary for the safe and timely delivery of your order. If you have a specific delivery requirement, such as a preferred carrier, contact us before ordering and we will do our best to accommodate it.
A product is your responsibility from the time it is delivered to the address you gave us. You own a product once we have received payment in full.
If no one is available to take delivery, the carrier will follow its own process for leaving the consignment or attempting redelivery. If delivery is repeatedly unsuccessful and the goods are returned to us, we may charge the cost of redelivery.
Full details are set out in our Payment & Delivery Policy.
7. Cancellation, returns and refunds
If you are a consumer, you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to change your mind within 14 days of receiving the goods and receive a refund. Certain products are excluded from this right, including goods made to your specification or clearly personalised, and sealed goods which are not suitable for return once unsealed.
We offer more than the legal minimum. Our standard return window is 30 days from the date of delivery, and returns may be for any reason except where the goods have been damaged by you after delivery. For customers in the United Kingdom we will pay the return shipping on items purchased within the last 30 days; after that period you must pay to return the goods to us. For orders delivered outside the United Kingdom you must always pay the return shipping costs.
Returned items can be replaced with the same product where available or a similar alternative by mutual agreement, refunded at the item price plus shipping (international shipping charges are excluded from the refund amount), or part-exchanged for a different product, with you paying or receiving credit for the difference.
To start a return, contact us at support@perfectpackaging.co.uk. The full policy, including how we handle warranty claims, is set out in our Returns & Replacements policy, which forms part of these terms.
8. Faulty or misdescribed goods
If you are a consumer, we are under a legal duty to supply products that conform to this contract. Nothing in these terms affects your rights under the Consumer Rights Act 2015, which include the right to a refund, repair or replacement where goods are faulty, not as described, or not fit for a purpose you made known to us.
Beyond that, we provide a 24-month warranty against product defects that were present at the point of purchase. It is for you to show that the defect was present at that time. This warranty is not transferable and ceases to apply if you sell the product on. Trade customers and businesses who buy products in order to resell them are not eligible for this warranty, though their statutory and contractual rights against us are unaffected.
Please inspect your delivery on arrival and tell us about any shortage, breakage or transit damage as soon as you reasonably can, so that we can pursue a claim with the carrier.
9. Our right to make changes and to end the contract
We may change a product to reflect changes in relevant laws or regulatory requirements, or to implement minor technical adjustments and improvements. We will tell you in advance if a change would materially affect the product, and you may then contact us to end the contract and receive a refund for products paid for but not received.
We may end the contract if you do not make a payment when due, or if you do not, within a reasonable time, allow us to deliver the products or provide us with information we have asked for and which is necessary for us to supply them.
10. Our responsibility for loss or damage
We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any matter in respect of which it would be unlawful for us to exclude or restrict liability.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, nor for any loss arising from your use of a product for a business purpose.
If you are a business customer, we exclude all implied terms, guarantees, conditions and warranties to the fullest extent permitted by law. We are not liable for loss of profit, loss of business, business interruption, loss of goodwill, loss of anticipated savings, or any indirect or consequential loss. Our total liability to you in respect of all losses arising under or in connection with a contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the price paid for the products concerned.
11. Events outside our control
We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event outside our reasonable control, including carrier failure, industrial action, adverse weather, fire, flood, epidemic, or the acts or omissions of a third-party supplier. If such an event occurs we will contact you as soon as reasonably possible and, where the delay is substantial, you may contact us to end the contract and receive a refund for products paid for but not received.
12. Intellectual property
All content on this website, including text, images, logos, product photography and page layout, is owned by us or our licensors and is protected by copyright and other intellectual property rights. You may not reproduce, distribute or use it commercially without our written permission.
13. How we use your personal information
We use your personal information only as set out in our Privacy & Cookie Policy.
14. Changes to these terms
We may amend these terms from time to time, for example to reflect changes in law or in how we operate. The terms that apply to your order are those in force on the date you placed it. We recommend saving or printing a copy of these terms when you order.
15. Other important terms
We may transfer our rights and obligations under a contract to another organisation. You may only transfer your rights or obligations under these terms to another person if we agree in writing.
This contract is between you and us. No other person has any right to enforce any of its terms. If a court finds part of these terms unlawful, the rest will continue in force. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things or prevent us taking steps against you at a later date.
16. Governing law and jurisdiction
These terms are governed by the law of England and Wales, and you and we both agree that the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
17. Complaints
If you are unhappy with a product or with our service, please contact us at support@perfectpackaging.co.uk so that we have the opportunity to put things right. We aim to acknowledge complaints within five working days.
